Vendor Terms & Conditions

Welcome to Odd Games TCG. By registering as a vendor on our platform, you agree to comply with the following terms and conditions. Please read this document carefully before proceeding with your application.

1. Acceptance of Terms

By creating a vendor account and using the Odd Games TCG marketplace, you acknowledge that you have read, understood, and agree to be bound by these Vendor Terms & Conditions. These terms constitute a legally binding agreement between you (the "Vendor" or "Seller") and Odd Games TCG (the "Platform" or "We").

If you do not agree to these terms, you must not register as a vendor or use our services.

2. Vendor Eligibility

To become a vendor on Odd Games TCG, you must meet the following eligibility requirements:

  • Age Requirement: You must be at least 18 years old or have reached the age of majority in your province of residence.
  • Location: You must be a resident of Canada.
  • Seller Type: You may register as either:
    • Individual: A personal collector wishing to sell trading cards from your collection.
    • Business: A registered business entity, including brick-and-mortar stores and online retailers.
  • Right of Refusal: Odd Games TCG reserves the right to refuse, suspend, or terminate any vendor account at our sole discretion, particularly in cases of non-compliance with these terms, fraudulent activity, or conduct that harms the platform or its users.

3. Vendor Plans & Pricing

Odd Games TCG offers three vendor plan tiers to accommodate sellers of all sizes. Each plan has specific features, listing limits, commission rates, and payment schedules:

3.1 Plan Changes

Vendors may upgrade or downgrade their plan at any time. Plan changes will take effect at the start of the next billing cycle. Downgrades may result in listings being deactivated if they exceed the new plan's listing limit.

3.2 Commission Deductions

The commission percentage is applied to each sale and is automatically deducted from the sale amount before funds are added to your vendor balance. Commission rates are based on your active plan at the time of sale.

3.3 Monthly Fees

Monthly fees for Growth and Pro plans are charged at the beginning of each billing cycle. Fees are non-refundable, even if you downgrade or cancel your account mid-cycle.

4. Product Quality Standards

To maintain marketplace integrity and customer satisfaction, all trading cards listed on Odd Games TCG must meet our quality standards.

4.1 Accepted Card Conditions

Only cards in the following conditions are permitted on our platform:

  • Near Mint (NM): Cards in excellent condition with minimal to no visible wear. Cards should appear almost new with only minor imperfections that are difficult to detect.
  • Lightly Played (LP): Cards with minor, acceptable signs of wear such as slight edge wear, minor scratches, or light whitening on corners. The card should still be in good overall condition.

4.2 Prohibited Card Conditions

Cards in the following conditions are NOT accepted on Odd Games TCG:

  • Moderately Played (MP)
  • Heavily Played (HP)
  • Damaged (DMG)

Listing cards that do not meet our quality standards may result in order cancellations, customer complaints, and potential account suspension.

4.3 Accurate Descriptions

Vendors must provide accurate and honest descriptions of card conditions. Misrepresenting card quality is a violation of these terms and may result in refunds, disputes, and account penalties.

5. Shipping Requirements

5.1 Shipping Deadlines

All orders must be shipped within a maximum of 5 business days following receipt of the order notification. Business days are defined as Monday through Friday, excluding Canadian statutory holidays.

Repeated failure to meet shipping deadlines may result in:

  • Warning notifications
  • Temporary account restrictions
  • Permanent account suspension

5.2 Shipping Methods & Fees

Vendors are responsible for shipping orders using the shipping method selected by the customer at checkout.

  • Default Shipping Options: Two Canada Post shipping options are configured by default on all vendor accounts. The shipping fees for these options are based on current Canada Post rates.
  • Custom Shipping Options: Vendors may create additional shipping methods according to their business needs and preferences.
  • Shipping Fee Management: Shipping fees paid by customers are added to your vendor balance and must be used to fulfill the shipment according to the selected shipping method. You are responsible for ensuring adequate packaging and proper delivery.

5.3 Shipping Fee Adjustments

Odd Games TCG reserves the right to adjust default Canada Post shipping rates if Canada Post increases their fees. Vendors will be notified of any rate changes in advance.

5.4 Packaging Standards

Vendors must carefully package all shipments to prevent damage during transit. Recommended packaging includes:

  • Card sleeves and top loaders for individual cards
  • Rigid mailers or padded envelopes for small orders
  • Boxes with adequate padding for larger orders

Vendors are liable for damage caused by inadequate packaging.

6. Financial Management

6.1 Payment Processing

For each sale completed on the platform, Odd Games TCG manages the complete transaction process:

  1. We collect the sale amount and shipping fees from the customer.
  2. We deduct the applicable commission based on your vendor plan.
  3. The remaining amount (sale + shipping fees - commission) is added to your vendor balance.

6.2 Vendor Balance & Withdrawals

You can view your current balance at any time through your vendor dashboard. Withdrawals are subject to the following conditions:

  • Minimum Balance: You must have a minimum balance of CA$20 to request a withdrawal.
  • Payment Schedule: Withdrawal frequency depends on your vendor plan:
    • Starter Plan: Bi-weekly withdrawals
    • Growth Plan: Weekly withdrawals
    • Pro Plan: On-demand withdrawals (any time you meet the minimum balance)

6.3 Shipping Fee Responsibility

Important: Shipping fees received from customers must be used to ship orders according to the configured shipping options. Vendors are responsible for fulfilling shipments with these funds and may not retain shipping fees without completing the shipment.

7. Tax Management

7.1 Sales Tax Collection & Remittance

Odd Games TCG handles all applicable Canadian sales tax collection and remittance on behalf of vendors. This includes:

  • GST/QST (Quebec)
  • GST/HST (participating provinces)
  • PST (provinces with provincial sales tax)

Important: Collected tax amounts are never added to the vendor's balance. Odd Games TCG collects, manages, and remits these taxes directly to the appropriate Canadian tax authorities.

7.2 Exception for Businesses with CRA Directives

If your registered business receives specific directives from the Canada Revenue Agency (CRA) regarding the management of sales taxes, you must contact Odd Games TCG immediately with official CRA documentation. Upon verification, we will redistribute taxes according to the specific recommendations provided by the CRA for your business.

7.3 Vendor Tax Obligations

While Odd Games handles sales tax collection, vendors remain responsible for:

  • Reporting income from sales on personal or business tax returns
  • Maintaining accurate records of sales and earnings
  • Complying with all applicable tax laws in their jurisdiction

We recommend consulting with a tax professional regarding your specific obligations.

8. Catalog & Listing Management

8.1 Centralized Product Catalog

Odd Games TCG maintains a centralized catalog of trading card products. Vendors list their inventory against existing products in the catalog to ensure consistency and accuracy across the marketplace.

8.2 Product Addition Requests

If a product you wish to sell does not appear in the catalog, you may submit a product addition request. Odd Games TCG commits to adding requested products within 48 hours of receiving your request.

8.3 Listing Accuracy

Vendors are responsible for:

  • Selecting the correct product from the catalog
  • Accurately representing card condition (NM or LP only)
  • Setting competitive and fair pricing
  • Maintaining accurate inventory quantities
  • Updating listings promptly when inventory changes

8.4 Prohibited Listings

Vendors may not list:

  • Counterfeit or fake cards
  • Cards that do not meet our quality standards (MP, HP, or Damaged)
  • Products unrelated to trading cards
  • Items that violate intellectual property rights
  • Any illegal or prohibited goods

9. Customer Service & Dispute Resolution

9.1 Direct Communication

In the event of a problem with an order (incorrect item, condition disputes, shipping issues, etc.), customers will first contact the vendor directly. Vendors are expected to:

  • Respond to customer inquiries promptly and professionally
  • Work toward an amicable resolution
  • Communicate clearly and courteously at all times
  • Offer reasonable solutions (refunds, replacements, partial refunds, etc.)

9.2 Odd Games Intervention

If a satisfactory resolution cannot be reached between the customer and vendor, either party may contact Odd Games TCG support at Admin@OddgamesTCG.ca.

When a dispute is escalated:

  • Odd Games will review all available evidence, including messages, photos, and transaction details
  • Both parties will have the opportunity to provide their perspective
  • Odd Games will make the final decision regarding the dispute
  • Decisions may include full or partial refunds, return requirements, or other remedies

Odd Games' decision in disputes is final and binding.

9.3 Vendor Performance

Repeated customer complaints, disputes, or negative feedback may result in:

  • Account review
  • Temporary restrictions
  • Permanent account suspension

10. Vendor Conduct & Quality Commitment

By accepting these terms, vendors commit to:

  • Honesty & Accuracy: Provide truthful and accurate descriptions of all products.
  • Professionalism: Communicate in a professional, courteous, and respectful manner with customers and Odd Games staff.
  • Quality Packaging: Carefully package all shipments to prevent damage during transit.
  • Timely Fulfillment: Ship all orders within the required 5 business day window.
  • Compliance: Adhere to all rules, policies, and terms outlined in this document.
  • Ethical Behavior: Refrain from fraudulent activity, price manipulation, false advertising, or any conduct that harms the platform or its users.

11. Account Suspension & Termination

11.1 Grounds for Suspension or Termination

Odd Games TCG reserves the right to suspend or terminate vendor accounts for violations including, but not limited to:

  • Repeated failure to ship orders within 5 business days
  • Listing prohibited card conditions or counterfeit products
  • Fraudulent activity or deceptive practices
  • Consistent customer complaints or disputes
  • Violation of any terms outlined in this agreement
  • Abusive or unprofessional conduct toward customers or staff
  • Misuse of the platform or attempts to circumvent fees

11.2 Suspension Process

Vendors will typically receive a warning for first-time minor violations. Serious or repeated violations may result in immediate suspension without prior warning.

11.3 Account Termination

Upon account termination:

  • All active listings will be removed
  • Outstanding balances will be processed according to normal withdrawal schedules (subject to any deductions for refunds, chargebacks, or penalties)
  • The vendor will be prohibited from creating a new account

12. Limitation of Liability

Odd Games TCG provides a marketplace platform to connect vendors and customers. While we strive to maintain a safe and reliable environment, vendors acknowledge and agree that:

  • Odd Games is not responsible for vendor-customer disputes beyond our dispute resolution process
  • Vendors are solely responsible for the accuracy of their listings and the quality of their products
  • Vendors are liable for shipping issues caused by inadequate packaging or failure to ship on time
  • Odd Games is not liable for lost revenue, business interruptions, or other indirect damages
  • Our total liability to any vendor is limited to the amount of fees paid by that vendor in the preceding 12 months

13. Modifications to Terms

Odd Games TCG reserves the right to modify these Vendor Terms & Conditions at any time. Vendors will be notified of material changes via email and/or through the vendor dashboard.

Continued use of the platform after changes take effect constitutes acceptance of the modified terms. If you do not agree to the changes, you must discontinue use of the platform and may close your account.

14. Governing Law

These terms are governed by and construed in accordance with the laws of Canada and the province of Quebec. Any disputes arising from these terms or your use of the platform shall be resolved in the courts of Quebec.
